CONDITIONS OF SALE

This document contains the General Conditions of Sale governing the purchase of products through the website at https://www.basepadelmilano.it hereinafter also referred to as "Site". As regards the production, preparation and packaging of the Products purchased on the Site, are intended to be carried out by Padel Milano Base. As a result of the foregoing, every product purchased on the Site is sold directly by New Works. New Works may change the terms of sale at any time. The new terms of sale will be effective from the moment of their publication.

Conclusion of the contract

This agreement between the Seller and the Customer is concluded by sending the order confirmation to the Customer by the Seller in the manner and terms indicated in the following Article. The conclusion of the contract implies the acceptance of these General Conditions of Sale by the Customer. If the Customer is a consumer once the online purchase procedure has been completed, he will print or save an electronic copy and, in any case, keep these General Conditions of Sale, in compliance with the rules on distance sales. If the Customer does not intend to accept the General Conditions of Sale, he must not proceed with the sending of the order at the end of the purchase path on the Site. Terms of purchase

The order will be validly processed upon receipt on the email box communicated by the Customer of the confirmation of payment of the order itself. The correct receipt of the order is confirmed by the Seller by an email sent to the e-mail address communicated by the Customer. This confirmation message will contain a customer order number to be used in any further communication with the Seller. The message reproduces all the data entered by the Customer, any information relating to the essential characteristics of the Products purchased, the indication of price, payment methods and delivery methods and costs. The Customer must verify the correctness and promptly notify any corrections to the customer service, in the manner described in this document. In case of non-acceptance of the order, the Seller guarantees timely communication to the Customer. The Seller purchases directly from the Supplier every Product available on the Site.

GUARANTEES FOR THE CUSTOMER

Pricing

The products will be sold at the prices in force at the time of the order by the Customer. The prices of the Products are inclusive of taxes and net of delivery costs that are counted separately before the conclusion and dispatch of the order.

Right of withdrawal

You can exercise the right of withdrawal on Products purchased on the Site without any penalty and without specifying the reason, returning to the Seller all or part of the Products purchased. The will to exercise the right of withdrawal must be manifested within the period of 15 days, starting from the day on which the Customer or a representative of the same (other than the courier) has acquired the possession of the Products. Within 14 (fourteen) days from the date on which the Customer has communicated his decision to withdraw from the Contract, the Customer shall send the Products duly packed to the Seller by courier chosen by the Customer.

However, it is understood that if the Products purchased are found to be non-compliant or present defects, the Customer will have the right to request the replacement of the same as indicated in the following paragraph "Non-compliant Products".

Preparation and fulfilment of the order

From the moment the Customer places an order on the Site, the time required for the preparation and shipment of the Products depends on the availability of the same. The site shows the availability of each Product and the indicative time of order processing. If during the execution of an order one or more products are no longer available, because they are out of stock or unavailable, the Seller will inform the Customer with an e-mail, the order will be updated with the elimination of the Products not available. The available Products will be shipped and the amount relating to the Products not available will be automatically deducted from the total amount of expenditure indicated at the time of purchase, regardless of the payment method chosen and the Customer will be refunded the value of the Products not evaded. The Seller will do everything possible to guarantee the Customer the respect of the delivery times indicated on the Site.

Photos and description of products

The Seller undertakes to deliver to the Customer the same products as those indicated and described in the pages of the site. However, please note that the images of the Products and Packaging on the site are used by the Customer to facilitate the recognition of the products. Variations are possible in the packaging of the Products such that the product delivered, although substantially the one purchased, has a different packaging than those presented on the Site. In any case, the characteristics, and indications of use on the label of the Product delivered will always be authentic.

Non-compliant products

If the Products purchased by the Customer show any lack of conformity with the sales contract, pursuant to the provisions of the law the Customer may request the replacement of the same (Legal Warranty). To obtain the replacement, the Customer must notify the difference by e-mail to the address info@basepadelmilano.it Before returning the goods, the Customer must wait for a reply from the Seller through the email address info@basepadelmilano.it . The Seller will send the Customer the data for the return of the goods. The Seller may not accept the returned goods for which the Customer has not obtained the authorization for the return by the Seller. The costs for the shipment of defective products to the Seller shall be borne by the Seller. Once received the defective Products and verified the actual discrepancy, the Seller will replace the Products by sending them to the Customer at its own expense. In the event that the Products declared non-compliant by the Customer are found to comply with the order, the Seller will inform the Customer that the return procedure cannot be terminated. In this case, the Seller will not send the Customer the Replacement Products: The Customer must collect the Products at the Seller’s expense within 30 days.

Applicable Law and Competent Court

This contract is governed by the Italian Law for the resolution of civil and criminal disputes arising from the conclusion of this Contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his Municipality of residence.
